End User License Agreement

This End User License Agreement is a binding agreement between you and Social Sips Inc. (the "Application Provider") covering StewardAI: Leadership Coach and any updates to it. It supplements, and in the event of a conflict with respect to the licensed application prevails over, Apple's standard Licensed Application End User License Agreement, which also applies to your use of the app.

You and the Application Provider acknowledge that this agreement is concluded between the two of you only, and not with Apple. The Application Provider — not Apple — is solely responsible for StewardAI: Leadership Coach and its content.

The licence granted for StewardAI: Leadership Coach is a non-transferable licence to use it on any Apple device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, and may also be accessed by other accounts associated with you via Family Sharing or volume purchasing.

You may not:

• Copy, distribute, sublicense, rent, lease, lend or sell the app or any part of it
• Modify, adapt, translate or create derivative works from the app
• Reverse engineer, decompile or disassemble the app, except to the extent applicable law expressly permits
• Remove or obscure proprietary notices, or circumvent security, licensing or usage limits
• Use the app on a jailbroken device, or use automated means to access it at scale

This agreement covers updates, upgrades and new versions of StewardAI: Leadership Coach unless a separate licence accompanies them. Updates may add, change or remove functionality. Where you have automatic updates enabled, they install according to your device settings; we support only reasonably current versions of the app and iOS.

StewardAI: Leadership Coach is licensed, not sold. The Application Provider and its licensors retain all right, title and interest in the app, including all copyrights, trademarks, trade secrets and other intellectual property. No rights are granted except those expressly stated here.

The Application Provider is solely responsible for providing maintenance and support services for StewardAI: Leadership Coach. Apple has no obligation whatsoever to furnish any maintenance and support services. Reach us at support@debouillet.com.

The Application Provider is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of StewardAI: Leadership Coach to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app.

The Application Provider, not Apple, is responsible for addressing any claims relating to StewardAI: Leadership Coach or your possession and use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

In the event of any third-party claim that StewardAI: Leadership Coach or your possession and use of it infringes that third party's intellectual property rights, the Application Provider, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using StewardAI: Leadership Coach. You and the Application Provider acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and that upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.

You agree that the Application Provider may collect and use technical data and related information — including device, system and application data — to facilitate software updates, product support and other services to you, as described in the Privacy Policy.

This licence is effective until terminated. It ends automatically if you breach it, and you may end it at any time by deleting StewardAI: Leadership Coach from your devices. On termination you must stop using the app and delete all copies. Provisions on ownership, disclaimers, liability and Apple's third-party beneficiary rights survive.

To the maximum extent permitted by law, the app is licensed "as is" without warranty of any kind, and the Application Provider's aggregate liability arising out of this licence is limited to the amount you paid for the app, or US$50 if greater. Apple bears no liability whatsoever in connection with the app.

The app and related documentation are "Commercial Items" as defined in 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", and are licensed to U.S. Government end users only as commercial items with the rights granted here.

This agreement is governed by the laws of the State of Texas, United States, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, and without limiting any mandatory consumer protections in your country of residence. If any provision is unenforceable, the remainder stays in effect.
